In exclusive information to mtv website, the head of the Change Movement party, lawyer Elie Mahfoud, accompanied by a team of lawyers from the party, is preparing to go to the Cassation Public Prosecution in the coming few days, to file a legal complaint against anyone proven to be involved in offending and demeaning the Maronite Patriarch, whether through caricatures, statements, or posts via media outlets and social media platforms.
According to the information, the complaint will be registered against anyone whom the investigation shows to be a perpetrator, accomplice, or instigator, and the most stringent legal measures will be requested against them, including arrest and criminal prosecution. The information indicates that Mahfoud intends to follow up on this case until its judicial conclusion, emphasizing no leniency in what he considers “an affront to religious and national figures.”
In the legal framework, this action falls under the provisions of the Lebanese Penal Code, which criminalizes acts that offend religious sentiment or involve demeaning or contempt for religious symbols. Several articles in the law stipulate punishing anyone who commits blasphemy or public contempt for religious rites or symbols, or offends beliefs, with penalties that may include imprisonment and fines, especially if done through public dissemination methods.
Legal sources also indicate that the description of the acts subject to the complaint may also fall under crimes against civil peace and inciting sectarian strife, if it is proven that the offensive content is likely to incite sedition or tension between segments of society.
It is worth noting that Mahfoud had taken a similar judicial path earlier, when he filed a complaint against Bechara El Asmar, based on statements considered offensive to the late Patriarch Mar Nasrallah Boutros Sfeir, which led to his arrest at the time, in a precedent that confirmed, according to sources close to Mahfoud, the seriousness of resorting to the judiciary in similar cases.
