Trump’s $100,000/Month “Truth API” Service Faces Federal Lawsuit

Two media organizations—The Intercept and the Freedom of the Press Foundation—filed a federal lawsuit against former U.S. President Donald Trump on Wednesday in Manhattan’s U.S. District Court. The suit seeks to terminate a new paid service called “Truth API,” operated by Trump Media & Technology Group, which grants early access to Trump’s posts on Truth Social, including those with potential market impact.

How the Truth API service operates

The Truth API service launched on August 1. It charges fees of up to $100,000 per month for priority access to ten key accounts on Truth Social, including Trump’s own account. The complaint alleges that this arrangement allows private subscribers to receive Trump’s statements before they become publicly available, creating an information asymmetry that could affect financial markets.

Regulatory scrutiny preceded the lawsuit

Four days before the service’s launch, Democratic U.S. Senators Elizabeth Warren of Massachusetts and Adam Schiff of California urged the U.S. Securities and Exchange Commission to investigate whether the Truth API undermines financial market integrity while enriching Wall Street, Trump, and his wealthy associates.

Trump’s use of Truth Social for policy announcements

Trump consistently uses Truth Social to disseminate news—including updates on tariffs and Middle East conflicts—that have demonstrable effects on stock prices, oil markets, and other financial sectors. According to the complaint, between 9,000 and 11,000 of Trump’s posts during his second White House term were published first—or exclusively—on Truth Social, without any corresponding official White House statement.

Legal arguments under the First Amendment

The lawsuit contends that the Truth API violates the First Amendment of the U.S. Constitution. It asserts that all members of the public hold an equal right to access Trump’s official communications and that no legitimate government interest justifies selling his posts to private subscribers for profit.

Request to halt exclusive government announcements

The plaintiffs also seek a court order barring the White House from publishing official government announcements exclusively on Truth Social while charging fees for access to them. The complaint states that such exclusivity, combined with monetization, transforms official presidential communications into commercial products.
