Draft Law Proposal on Staff of the Educational Center for Research and Development
MP Bilal Abdullah submitted a draft law to Parliament proposing that permanent staff at the Educational Center for Research and Development be subject to public sector retirement and severance systems.

MP Bilal Abdullah submitted a draft law to the Parliament aiming to subject employees at the Educational Center for Research and Development to the retirement and dismissal system, stating:
"Article 1:
Permanent employees at the Educational Center for Research and Development shall be granted, upon the end of their service, the right to choose between a pension and severance pay, in accordance with the conditions applicable to permanent employees in public administrations. Entitlements shall be paid to those concerned from the Center's budget.
Article 2:
From the date this law enters into force, deductions for retirement and severance pay applicable to permanent employees in public administrations shall be deducted from the basic salary of employees at the Center. Any amendments to these percentages shall apply without the need for another text to be issued.
Article 3:
Employees working at the Center when this law enters into force must decide, within three months of its effective date, whether to benefit from its provisions or remain in their previous status. The choice shall be made via a declaration signed by the employee concerned and registered with the administrative department within the aforementioned period.
No application submitted after this period will be accepted, nor may the declaration be modified or withdrawn once registered.
Article 4:
Employees who chose to benefit from the provisions of this law shall pay the differences in retirement deductions due for their previous service, recalculated according to the rates applicable to permanent employees in public administrations. Payment shall be made in monthly installments deducted from the basic salary at a rate of ten percent (10%), until all due amounts are settled.
If an employee's service ends before full payment is completed, and they have chosen a pension, they shall continue paying installments as practiced during service. If they have chosen severance pay, the remaining balance shall be deducted in one lump sum from the compensation.
As for those working at the Center before the publication date of this law who chose to remain in their previous status regarding severance pay, the same percentage deducted from the salaries of their colleagues under Article 2 of this law shall be deducted from their salaries from the date of entry into force, while the percentage deducted for their previous service remains unchanged.
Article 5:
This law shall come into effect immediately upon its publication in the Official Gazette
Justification Reasons
Since the Educational Center for Research and Development is a public institution of a special nature, its permanent workers are subject to the provisions of its establishment law, and the retirement and dismissal systems applicable to permanent employees in public administrations do not apply to them.
Since the permanent employees at the Center perform tasks related to the public utility, contribute to achieving its educational and research goals, and many dedicate long years of their professional lives to serving it.
Since providing a retirement guarantee for employees would enhance their confidence in their future livelihood, consolidate their job stability, and positively reflect on their morale and productivity.
Since requirements of functional and social equity necessitate allowing permanent employees at the Center to benefit from the pension and dismissal system, under the same conditions applicable to permanent employees in public administrations.
Since applying this system to current employees requires addressing their transitional situations, ensuring them the freedom to choose between benefiting from the proposed law or remaining in the previous status, within a specified deadline and through a clear and final written declaration.
Since admitting employees wishing to benefit from the system requires calculating their previous service and settling the differences in deductions due for it, enabling them to pay these differences in monthly installments, taking into account their situation if service ends before completion of payment.
Since it is necessary, at the same time, to regulate the status of employees who choose to remain under the previous system, so that deductions established for their subsequent service after the law's entry into force continue, while keeping the settlement of their previous service under the provisions previously applied to them.
Since linking deduction rates to those applicable to permanent employees in public administrations, and to any amendments occurring therein, ensures unity of standards and avoids the need to issue new legislative texts upon every amendment.
Therefore, the draft law was prepared aiming to subject permanent employees at the Educational Center for Research and Development to the retirement and dismissal system, defining the mechanism for current employees' choice, settling differences in deductions for previous services, and clarifying the provisions applicable to those choosing to benefit from the system or remain in their previous status."
